interfere with or disrupt any user, host, or network, for example by sending a virus, overloading, flooding, spamming, or mail-bombing any part of the Services;
access or search the Services by any means other than our publicly supported interfaces (for example, 'scraping');
send unsolicited communications, promotions or advertisements, or spam;
send altered, deceptive or false source-identifying information, including 'spoofing' or 'phishing';
promote or advertise products or services other than your own without appropriate authorization;
abuse Bar Patrol referrals or promotions to get more storage space than deserved;
abuse the Services in a manner that circumvents their storage space limits;
sell the Services or Services accounts via unauthorized channels;
use automated or other means to create accounts in bulk or to access the Services other than by using our official interface and/or APIs;
publish or share materials that are unlawfully pornographic or indecent, or that advocate bigotry, religious, racial or ethnic hatred;
violate the law in any way including storing, publishing or sharing material that's fraudulent, defamatory, misleading, or that violates the privacy or infringes the rights of others. Bar Patrol will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it. Client acknowledges and agrees that the technical processing and transmission of electronic communications is fundamentally necessary to the use of the Services. Client agrees that Bar Patrol is not responsible for any electronic communications and/or data which are lost, altered, intercepted or stored without authorization during the transmission of any data across networks not owned and/or operated by Bar Patrol.

Any links to third-party software available on this website are provided 'as is' without warranty of any kind, either expressed or implied and such software is to be used at your own risk. The use of the third-party software links on this website is done at your own discretion and risk and with agreement that you will be solely responsible for any damage to your computer system or loss of data that results from such activities. WE ALSO DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
INTELLECTUAL PROPERTY, SOFTWARE AND CONTENT
The intellectual property rights in all software and content (including photographic images) made available to you on or through this Website remains the property of Bar Patrol or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by Bar Patrol and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.
TERMS OF SALE
By placing an order Client is offering to purchase services and/or products on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. In order to contract with Bar Patrol Client must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to Bar Patrol. Bar Patrol retains the right to refuse any request made by the Client. If the order is accepted Bar Patrol will inform Client by email confirmation. This will usually be Bar Patrol or may in some cases be a third party. Where a contract is made with a third party Bar Patrol is not acting as either agent or principal and the contract is made between Client and that third party and will be subject to the terms of sale which they supply to Client. When placing an order, Client undertakes that all details provided to Bar Patrol are true and accurate, that Client is an authorized user of the credit or debit card used to place the order and that there are sufficient funds to cover the cost of the services. The cost of equipment may fluctuate. All prices advertised are subject to such changes.
(a) Registration Information
Client agrees to provide accurate, current and complete information as prompted by the registration form which you will fill out online in order to gain access to the Service.
(b) Our Contract
When Client places an order, they will receive an acknowledgement e-mail confirming receipt of the order: this email will only be an acknowledgement and will not constitute acceptance of the order. A contract between Bar Patrol and Client will not be formed until a confirmation e-mail is sent stating that the services and/or products which Client ordered have been dispatched to Client. Only those goods or services listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.
While Bar Patrol attempts to ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If Bar Patrol discovers an error in the price of any services and/or products which have been ordered, Client will be informed of this as soon as possible and the option will be given for reconfirming the order at the correct price or cancelling it. If Bar Patrol is unable to contact Client the order will be treated as cancelled. If Client cancels and Client has already paid for the services and/or products, Client will receive a full refund.
If Client has signed up for a yearly plan and wishes to cancel before the year is up, Bar Patrol will refund the Client the pro-rated amount; however, Client will not receive discounted yearly price. Client will be charged normal monthly price up until the time of cancellation.
Bar Patrol charges and collects for the Services in advance. On the renewal date, Bar Patrol will automatically renew your subscription and bill you for the new term. If you do not wish to renew then you must cancel your plan according to the terms outlined below a minimum of fourteen (14) days prior to the renewal date. Unless specified otherwise, all fees and charges are non-refundable and there are no refunds or credits for partially used periods.
(e) Grace Period
Bar Patrol allows Client a thirty (30) day grace period from beginning of the renewal period. If Client does not bring balance current within this thirty (30) day grace period, Bar Patrol may suspend Client’s access to the Services until the amount outstanding is paid in full.
Your Bar Patrol Online account will continue as a recurring payment unless and until you cancel the account or Bar Patrol terminates your account. You must cancel your plan at any time from within the Account Information page of the Barkeep Online application, or by notifying Barkeep Online Support by email. You must cancel your Barkeep Online account at least fourteen (14) days before the end of your billing cycle anniversary date in order to avoid billing of the next cycle's fees.
BURDEN OF RESPONSIBILITY
Client acknowledges and agrees that they should not rely on the Bar Patrol for any reason, and that you are solely responsible for maintaining and protecting all data that is stored, retrieved or otherwise processed by Bar Patrol’s website or through your use of the services. Without limiting this, Client will be responsible for all costs and expenses that you or others may incur with respect to backing up, and restoring or recreating any data and information that is lost or corrupted as a result of your use of Bar Patrol’s website and/or services unless expressly agreed otherwise between Client and Bar Patrol.
Client is responsible for safeguarding the password used to access the Bar Patrol Website and Services. Client agrees not to disclose password to any third party. Client also agrees to take sole responsibility for any activities or actions under the password, whether or not Client has authorized such activities or actions. Client will immediately notify Bar Patrol of any unauthorized use of Client’s password.
DISCLAIMER OF LIABILITY
The material displayed on this Website is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law Bar Patrol and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. Client agrees to indemnify, defend and hold harmless Bar Patrol, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from use of this Website or the breaching of the Terms of Service.
Bar Patrol shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.
If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.
Bar Patrol operate a complaints handling procedure which they use to try to resolve disputes when they first arise, please let Bar Patrol know if you have any complaints or comments.
If you breach these conditions and Bar Patrol takes no action, Bar Patrol will still be entitled to use its rights and remedies in any other situation where you breach these conditions.
The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Bar Patrol. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of Bar Patrol.
You're free to stop using the Services at any time. Bar Patrol also reserves the right to suspend or end the Services at any time at our discretion and without notice. For example, we may suspend or terminate your use of the Services if you're not complying with these Terms, or use the Services in a manner that would cause us legal liability, disrupt the Services or disrupt others' use of the Services. Except for Paid Accounts, we reserve the right to terminate and delete your account if you have not accessed your account within the past twelve (12) months. Bar Patrol will provide you with notice via the email address associated with your account before we do so.
BAR PATROL may revise these Terms from time to time, and will always post the most current version on our website. If a revision meaningfully reduces your rights, we will notify you. By continuing to use or access the Services after the revisions come into effect, you agree to be bound by the revised Terms.
WAIVER, SEVERABILITY AND ASSIGNMENT
Bar Patrol’s failure to enforce a provision is not a waiver of its right to do so later. If a provision is found unenforceable, the remaining provisions of the Terms will remain in full effect and an enforceable term will be substituted reflecting our intent as closely as possible. You may not assign any of your rights under these Terms, and any such attempt will be void. Bar Patrol may assign its rights to any of its affiliates or subsidiaries, or to any successor in interest of any business associated with the Services.
These Terms will be governed by California law except for its conflicts of laws principles.
